The present terms and conditions of sale apply exclusively to the company Jane again cashmeres (hereafter "JAC") and any person visiting the website or buying a product from the website janeagaincashmeres.com (hereafter the "Client"). The terms and conditions of sale are available for anyone to read on the website janeagaincashmeres.com (hereafter the "Website"). These terms and conditions of sale can be modified at any time. The terms and conditions applicable are those on the website at the date of the order.

Orders
Terms and conditions for placing an order
The Client declares :
To be age of 18 or over with the legal capacity to place an order on the website
To have a parental authorisation in case he is under the age of 18
To have authority for his personal assets
To accept without reserve these terms and conditions of sale
To be fully authorised to use a payment card to pay for his order
To have access to sufficient funds for the full payment of his order.
If one or more of these conditions are not met, the Client is not authorised to use this website and place an order.
After placing an order, JAC will send the Client a confirmation email.

Products
JAC presents on its website various Products for sale, along with their detailed descriptions.
JAC takes the utmost care to ensure that the colour, design and presentation of the Products, photos of which are displayed on the website, are faithful to the original products.
However, given the method of presenting the products on the website, it is possible that the appearance perceived by the Client of the photographic representation of the Products does not correspond to the Product itself exactly. JAC cannot be held responsible in the event of a manifest error between the product's characteristics and their representation.

Price, availability, delivery, receipt and customs
Price
The prices shown on the website are in euros and include other applicable costs such as :
- order processing fees
- not including postage/shipping which will be billed as an extra cost
The Client is informed that delivery costs are charged on top of the price of the Product and that these costs will be specifically indicated on the order summary and in the order confirmation email.
JAC reserves the right to change its prices at any time and without warning. Products already ordered will be invoiced at the prices when the order was placed.

Availability
The Products offered for sale by JAC are those that appear on the Site at the time of their consultation by the Client and within the limit of yarn availability. JAC reserves the right, at any time, to modify or cease to offer the Products offered on the Site; these changes will, however, have no effect on the orders accepted by JAC before these changes were applied.

Insurance
JAC insures each purchase during the time it is in transit until it is delivered to you. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfilment by JAC and transfer of responsibility in the same way.

Payment
Accepted methods of payment
The payment of an order can be made by Visa/Mastercard, American Express and Apple Pay.
The information for payment (address, amount, order, etc.) can be found in the order confirmation and must be respected to the letter to ensure the order is processed.
Payment by cheque or postal order is not accepted.
Payment refused and order cancellation

For security reasons, JAC reserves the right to refuse payments and also cancel orders:
- if a delivery address is not referenced, deliveries to hotels and PO boxes
- if the person who placed the order cannot be contacted
- if there are any doubts about the legitimacy of the order

Payment Security
All payments are done through the Stripe software that allows us to provide a maximum guarantee for the customer.
However, if for any reason the customer wishes to pay through a bank transfer, it is possible.

Liability
JAC declines all liability in the case where the item delivered does not respect the laws of the destination country outside of the European Union.
JAC will take every professional precaution to ensure customer service. Nevertheless, JAC cannot be deemed liable if they are unable to fulfill their contractual obligation due to unforeseeable circumstances or force majeure as defined by jurisprudence under French jurisdiction.

Under no circumstances could JAC be considered liable for the loss of profit, commercial loss, loss of data, loss of income or any other indirect loss or which was not foreseeable at the time of visiting the website or at the time of concluding the contract of sale between themselves and the Client.

JAC's responsibility will not be engaged due to any inconveniences or damages inherent to the use of the Internet network, notably a break in service, the occurrence of bugs, an external attack or the presence of computer viruses.

Reserve of ownership
The goods delivered will remain property of JAC until the Client takes physical possession of the delivered product once it has been paid for.

Right of withdrawal
JAC is primarily concerned with the satisfaction of his Client. The Client has an unconditional right of withdrawal without explanation within fourteen (14) calendar days of delivery of the items ordered from the online store.

Please note that the returned products must not have been used. If the Client would like to exercise his right of withdrawal and cancel the contract of sale, JAC will refund the amount spent less any postage for the ordered items which remains at his cost and under the condition that the products have not been worn or damaged and are returned in their original Jane again cashmeres packaging, otherwise the item will be sent back to the Client.

To exercise his/her right of withdrawal, the Client must inform JAC of his decision to withdraw within fourteen (14) days of receipt of his/her purchase, To initiate a return, or an exchange the Client must contact JAC Customer Service via info@janeagaincashmeres.com and return the forms and items by any secure means and against signature to the following address:

Returned items must be in their original packaging.

Postage for returned items is at the Client's cost.

Following receipt of returned items, JAC will immediately refund the Client the entire order excluding postage costs. The refund will be by bank transfer to the card that was used to pay the initial invoice. Returned items can be replaced or exchanged. 

Website access and property rights
JAC grants the Client access to and the use of the website for his/her own personal use. 

The reproduction or use of all or part of these elements is only authorised for information purposes for personal and private use; any reproduction or use of copies made for other purposes is expressly prohibited. Neither the Site, in full or in part, nor its contents can be used, reproduced, duplicated, copied, transferred, made accessible, modified or used in any other manner, in full or in part, for any purpose whatsoever without prior written authorisation from JAC. Any other use constitutes a forgery.

Personal data protection
JAC pledges to protect any and all personal data pertaining to its Clients. All personal data pertaining to the Client collected by us will be processed in the strictest confidentiality, in compliance with our policy for personal data protection:

- Client's personal data collected from elements that he/she enters into the website will exclusively be used to process his/her order in the best possible conditions and to recommend suitable offers

- Client's personal data are never rented out, sold or passed on to a third party, other than to process your order.

- The Client has the right to access, oppose, modify and delete all of his personal information by writing to jane@janeagaincashmeres.com (Loi "informatique & liberté" du 6 janvier 1978 modifiée en 2004)

- Non-personal data provided by the Client's activity on the website is used to improve customer services, in particular website usability, products presented and customer relations.
The processing of information provided by the intermediary of the website www.janeagaincashmeres.com is the object of a CNIL declaration (xxx).

Jane again cashmeres store is hosted on Squarespace Inc. They provide the online e-commerce platform that allows JAC to sell its products and services to you.

Your data is stored through Squarespace’s data storage, databases and the general square space application. They store your data on a secure server behind a firewall.Non-compliant product(s)

Right of compliance and warranty
JAC guarantees respectively that the brand's Products comply with the use for which they are intended and do not present any faults or hidden defects making them dangerous or unsuitable for their normal use.

 In the case of a Product not complying with the information given during presentation of the Products on the Site, and in accordance with article L.211-5 of the Consumer Code, or if these Products present hidden defects referred to in article 1641 of the Civil Code, the Client will receive a refund within thirty (30) days of the date on which the Product is received, subject to respect of the conditions mentioned below.

In this respect, it is specified that JAC does not accept packages sent postage due and that the Product must be returned in its original condition and packaging. JAC declines all liability in the case of damage, loss or theft during transportation. The Client will attach the return to the package. JAC will inspect the Product for non-conformity and if this is confirmed the Client will receive a refund.

This refund will be made to the bank account debited when the order was placed for the Product within thirty (30) days of CLB receiving the non-compliant Product. This refund will also include the refund of the initial delivery costs if all the Products delivered are returned. If only part of the order is returned, the initial delivery costs will not be refunded.

All risks related to the Product's return shall remain the Client's responsibility.

Applicable law and jurisdiction
The present terms and conditions of sale are subject to French law.

Any disputes concerning the commercial relationship between JAC and the Client are subject to French jurisdiction
